Flexible Working Regulations 2014

The new Flexible Working Regulations 2014 came into force on the 30th June this year.

Any employee who has been employed for more than 26 weeks (Not just parents of children under 17, or 18 if disabled, and certain carers, as currently is the case), has the right to make a request for flexible working.

Although employees have the right to make up to one request per year and the employer must deal with it within 3 months, there are eight broad business groups that can mean the application is refused.

In the event of refusal, a tribunal will not normally investigate the reason for refusal, but will decide whether procedures have been properly followed.

The maximum compensation for failure to comply is currently 8 weeks’ pay, based on the current cap of £464 per week.
